Historically, adultery was illegal in California under the “alienation of affection” law, but legislation has been passed that abolishes this form of litigation. California defines marriage as “husband and wife contract toward each other obligations of mutual respect, fidelity, and support,” so adultery can still be considered a breach of contract, for which suit may be brought. The state of California does not release official divorce rate statistics, but according to recent Census data, in 2008 8.3% of California men divorced and 9.9% of California women divorced, but it is difficult to know how many of these divorces were the result of adultery. The reason for divorce doesn’t matter in California because it is a “no fault” state, so all property will be divided equitably whether adultery can be proved or not, except in the case of “community property” funds spent outside the marriage. Being a community property state means that California considers all money earned (excluding gifts and inheritances) between the date of marriage and the date of separation to be community property. In California, all private investigators must be licensed through the Licensing Division of the Bureau of Security and Investigative Services. Applicants must also complete 3 years (2,000 hours a year, for a total of 6,000 hours) of paid investigative work prior to qualifying for licensure; up to one year (2,000 hours) can be substituted for a law or police sciences degree.
